Welcome to Yieldeck. These Terms and Conditions govern your use of our property management platform and services. By accessing or using Yieldeck, you agree to be bound by these terms.
2. Services Description
Yieldeck provides a property management system (PMS) for landlords and property managers. Our services include:
- Digital lease agreement creation and management
- Electronic signature capabilities with legal compliance in Spain
- Tenant and property management tools
- Financial tracking and reporting
- Document storage and organization
3. Contract Data Usage
By creating or uploading contracts through Yieldeck, you acknowledge and agree that Spotahome, S.L. (the parent company of Yieldeck) may access and review the content of your contracts for the purpose of improving our platform, services, and your overall user experience. This may include analyzing contract structures, identifying common patterns, and enhancing our tools and features. We will handle all contract data in accordance with our Privacy Policy and applicable data protection laws.
4. Spotahome Services
By registering on Yieldeck, you consent to Spotahome, S.L. contacting you regarding listing and signing your property on the Spotahome platform. You may opt out of these communications at any time by contacting us.
Spotahome, S.L. reserves the right to introduce fees for the contract signing services provided through the Yieldeck platform at any time. Any changes to pricing will be communicated to you with reasonable prior notice. Your continued use of these services after such notice constitutes acceptance of the updated pricing terms.
5. User Accounts
To use our services, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information during registration
6. Electronic Signatures
Yieldeck provides Simple Electronic Signature (SES) capabilities compliant with Spanish law. By using our electronic signature features, you acknowledge that:
- Electronic signatures created through our platform are legally binding
- You consent to conducting business electronically
- You are responsible for verifying the identity of signing parties
7. Data Protection
We handle your personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR). As a data controller, you are responsible for ensuring you have appropriate legal bases for processing tenant and property data through our platform.
8. Acceptable Use
You agree not to use Yieldeck for any unlawful purpose or in violation of these terms. Prohibited activities include:
- Uploading malicious content
- Attempting to access other users' accounts
- Using the platform for fraudulent activities
- Violating intellectual property rights
9. Intellectual Property
All content, features, and functionality of Yieldeck are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to the platform.
10. Limitation of Liability
Yieldeck is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for our services in the twelve months preceding the claim.
11. Termination
You may terminate your account at any time by deleting your account through the platform settings. We reserve the right to suspend or terminate your access if you violate these terms. Upon termination, your data will be handled in accordance with our Privacy Policy and GDPR requirements.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
13. Changes to Terms
We may update these terms from time to time. We will notify you of any material changes by email or through a notice on our platform. Your continued use of Yieldeck after such changes constitutes acceptance of the updated terms.
